|content=[[Companies/Nintendo|Nintendo]] has filed a lawsuit against third-party accessories maker Genki, accusing the company of trademark infringement, false advertising, and unfair competition related to its promotion of products for the unreleased Nintendo Switch 2.

According to legal documents filed in a California court, the Japanese gaming giant claims Genki launched a marketing campaign in late 2024 designed to exploit public anticipation for its next-generation console, which Nintendo officially unveiled on April 2, 2025.

“Beginning at least as early as December 2024, Defendant embarked upon a strategic campaign intended to capitalize on the public interest surrounding Nintendo’s next-generation console,” Nintendo’s legal team stated in the filing.

The lawsuit alleges that in January 2025, Genki publicly displayed a "mockup" of the Nintendo Switch 2 and claimed to have gained unauthorized access to the console prior to its official announcement. Genki allegedly used this purported access to promote accessories it said were compatible with the upcoming device.

“Defendant began advertising that it gained unauthorized access to Nintendo’s upcoming Nintendo Switch 2 console, which had not yet been released or even revealed publicly by Nintendo,” the complaint continues. “Defendant also advertised that because of its unique access to a genuine unreleased Nintendo Switch 2 console, it could manufacture gaming accessories that are compatible with the Nintendo Switch 2.”

Nintendo disputes those claims, asserting that compatibility cannot be confirmed without official access to the console’s hardware or technical specifications. According to the lawsuit, this raises serious legal concerns about how Genki obtained information about the unreleased system.

The filing outlines two possibilities: “Defendant is either not in possession of a genuine console and thus cannot claim compatibility with enough certainty to make its advertising claims in good faith,” or it “unlawfully or illicitly obtained an authentic Nintendo Switch 2, or proprietary technical information about the Nintendo Switch 2, prior to the console’s release to the public.”

Nintendo is seeking a court order to prevent Genki from using its trademarks, including the Nintendo Switch name and logo, and from making what it calls “false representations or statements” regarding the compatibility of its accessories with the Switch 2.
